Terms of Service
General terms for using this website and engaging MOGA Technologies for digital services. A project quotation, proposal or signed agreement may contain additional or different commercial terms.
Scope and priority of project documents
These Terms of Service apply generally to the MOGA Technologies website and to services we provide, including landing pages, business websites, web systems, Android applications, Windows software, hosting, maintenance and related technology services.
Specific project scope, pricing, milestones, revisions, support periods and delivery assumptions are normally stated in a quotation, proposal, statement of work or other written agreement. If there is a conflict, the specific written project document will take priority for that project.
Quotations, deposits and payments
- Quotations are based on the information available when they are prepared and remain valid for the period stated in the quotation.
- A project may require a deposit or milestone payment before work begins or progresses. The applicable payment schedule will be stated in the quotation or agreement.
- Prices are stated in Malaysian Ringgit unless another currency is expressly stated.
- Third-party charges such as domains, hosting, licences, payment gateways, app-store fees, messaging fees, external APIs or paid subscriptions are excluded unless the quotation specifically says they are included.
- Late or outstanding payments may delay delivery, support, deployment or renewal of services where permitted by the applicable agreement and law.
Client responsibilities
Clients are responsible for providing accurate requirements, timely feedback, approvals, access credentials where necessary, and lawful content or materials needed for the project. The client confirms that it has the right to use any text, images, logos, data, trademarks or other materials supplied to MOGA Technologies.
Delays in receiving required information, approvals or access may affect the project schedule.
Scope changes, revisions and delivery
Reasonable revisions included in the agreed scope will be handled according to the project quotation. New modules, features, redesigns, integrations or requirements outside the agreed scope may require a revised quotation, change request, additional fee or adjusted delivery date.
Delivery dates are estimates unless expressly agreed as fixed dates. We will communicate material delays that become known to us.
Intellectual property and project materials
Ownership and licence terms for custom deliverables will follow the relevant quotation or project agreement. Unless otherwise agreed, MOGA Technologies retains ownership of its pre-existing tools, reusable components, frameworks, know-how, templates and general-purpose code, while the client receives the rights to the agreed project deliverables after applicable payment obligations are satisfied.
Third-party software, fonts, libraries, APIs and other components remain subject to their respective licences and terms.
Third-party platforms and services
Projects may rely on third-party services such as domain registrars, hosting providers, cloud platforms, app stores, payment gateways, email or messaging providers, external APIs and software libraries. Their availability, pricing, policies and performance are controlled by those providers and may change independently of MOGA Technologies.
Where a third-party account or service is owned or managed by the client, the client remains responsible for maintaining that account and its charges unless otherwise agreed.
Hosting, maintenance and support
Hosting, maintenance, backups, monitoring, renewals and ongoing support are provided only where included in the relevant plan, quotation or agreement. Support does not automatically include new features, major redesigns, third-party changes or work outside the supported scope.
Where MOGA Technologies manages a renewable service for a client, renewal pricing and due dates may be communicated separately. Client-managed services remain the client's responsibility unless MOGA Technologies has expressly accepted management of that service.
Availability, warranties and liability
We aim to provide professional and reliable services, but websites, software and online services may be affected by internet outages, third-party failures, security incidents, device compatibility issues or circumstances beyond reasonable control. Except where required by law or expressly stated in a written agreement, services are provided without a guarantee of uninterrupted or error-free operation.
To the extent permitted by applicable law, neither party will be responsible for indirect or consequential losses that were not reasonably foreseeable from the agreed service. Any project-specific limitation of liability will be governed by the applicable quotation or agreement.
Cancellation, suspension and termination
Cancellation, refunds, handover arrangements and termination rights will follow the applicable quotation or agreement and the work already completed. MOGA Technologies may suspend affected services where reasonably necessary for security, unlawful use, material breach, or unpaid amounts, subject to applicable contractual terms and law.
Governing law and contact
These general terms are governed by the laws of Malaysia. Any dispute that cannot be resolved through good-faith discussion will be handled in accordance with applicable Malaysian law and any dispute provisions in the relevant project agreement.
